Ante la crisis ambiental por la que está pasando actualmente el Mar Menor, provocado por un cúmulo de actuaciones derivadas de las diferentes actividades urbanísticas, ganaderas, agrarias, mineras, así como un crecimiento frenético del turismo de los alrededores del ecosistema lagunar del Mar Menor, se pretende hacer un repaso desde el punto de vista legislativo sobre el reconocimiento de derechos para la preservación del medio marino y sus especies. Para ello, estudiaremos la evolución de los derechos de la naturaleza, las diferentes causas que han provocado un ecosistema frágil y desequilibrado, y el papel que han asumido las diferentes administraciones públicas responsables y competentes con la capacidad para llevar a cabo políticas públicas y estrategias de protección y conservación del ecosistema del Mar Menor. Además, comprobaremos que el pensamiento científico se inclina en la urgente necesidad de aplicar medidas de recuperación, que la protección de las especies marinas y su entorno forma parte del discurso político y como un movimiento social puede provocar una importante evolución de equilibrio jurídico entre un entorno natural y los derechos del hombre, considerando al primero como un verdadero sujeto de derechos y al segundo como parte integrante de un ecosistema global. In view of the environmental crisis that the Mar Menor is currently going through, caused by an accumulation of actions derived from different urban, livestock, agricultural and mining activities, as well as the frenetic growth of tourism in the area surrounding the lagoon ecosystem of the Mar Menor, the aim is to review from a legislative point of view the recognition of rights for the preservation of the marine environment and its species. To do so, we will study the evolution of the rights of nature, the different causes that have led to a fragile and unbalanced ecosystem, and the role assumed by the different responsible and competent public administrations with the capacity to carry out public policies and strategies for the protection and conservation of the Mar Menor ecosystem. Furthermore, we will see that scientific thought is inclined towards the urgent need to apply recovery measures, that the protection of marine species and their environment forms part of the political discourse and how a social movement can provoke an important evolution in the legal balance between a natural environment and the rights of man, considering the former as a true subject of rights and the latter as an integral part of a global ecosystem.
